Niland was prosecuted under Section 135 of the Defence Act for failing to render himself available for personal service. He argued that the he had difficulty with shifts as loco driver, and this had rendered him 7 ½ days short. He was committed to Fremantle Barracks for 14 days (West Australian Newspapers 31.7.1913). Niland was granted exemption from National Service on grounds of being the only son, of Midland Junction Cr. (West Ward) T. J Niland. (Daily News 9.11.1916). He worked with Government Railways as a Loco Driver.
